Licensing act 2003 – licence applications

The time for converting your Justices' Licence is now over. This means the grandfather rights you were given to allow you to convert your licence have expired.  If you have not submitted an application to convert you will now have to apply from scratch for a premises licence.  This is a more lengthy process; not only must you complete a full operating schedule, your application must be advertised locally on your premises and in a local newspaper as well as being considered by all responsible authorities.

What do you need to do?

The Licensing Act 2003 aims to promote four key objectives to enable more freedom for business operators and customers, while clamping down on crime, disorder and anti-social behaviour.

The four key objectives are: 

  • the prevention of crime and disorder 
  • public safety 
  • the prevention of public nuisance 
  • the protection of children from harm

The objectives will be mainly met through the introduction of two new types of licence, a premises licence and a personal licence. 

We will issue both of these new licences.

New policies

As required by law, we will be setting up a new Licensing Committee to oversee and manage the licensing process. The council must also produce a Licensing Policy Statement that explains how it will operate the licensing scheme for the next three years.

Fees

Certain premises are exempt from paying a fee for the premises licence. These include church halls, village halls and schools and colleges (where the entertainment is provided for the school and for educational purposes).

Standard: We will issue liquor licences within 35 days of completed applications
