Charitable collections and street trading licences

We grant and manage licences for charitable collections and street trading.

Street trading

A licence is needed for street trading.

Street trading means the selling, exposing for sale or offering for sale of any article (including a living thing) or the supplying or offering to supply any service in a street for gain or reward.

We have adopted powers under the Local Government (Miscellaneous Provisions) Act 1982 so that we may control or prohibit street trading in the central areas of Swadlincote.

Using these powers we have designated "consent streets" where street trading is only allowed with our consent, and then only in specified trading locations.

Restrictions

Street trading licences can only be issued for sites that have been designated as licence sites. However, where a person wishes to trade from a place that is not a designated site, licensing inspectors will consider designating that place as a licence site.

  • Consent may not be granted when adverse comments are received from the consulted parties.
  • Consent will not be granted where there is a risk to road safety or possibility of a nuisance being created.

Exemptions

A licence is not required if:

  • trading as a peddler under licence issued by a police authority
  • a market trader operating at a licensed market venue
  • you are trading on private land you may not need consent. To confirm the situation you are advised to contact us. The landowner may also need planning permission and you are advised to contact our planning office.

Licence conditions

Each street trading licence issued by us is subject to standard licence conditions. Amongst other matters these conditions relate to matters such as:

  • the name of the person who may trade
  • the goods that may be sold
  • the exact site where trading may take place
  • the days and times when trading can take place
  • displaying the licence holders name and licence number
  • heating and lighting arrangements
  • disposal of rubbish.

Applying

The applicant will need to provide evidence of a Public Liability Insurance and that your business is registered with the local authority for sale of food.

Benefit or charge

In addition to the application fee and yearly fee payable quarterly. there is a daily charge for each day that the licence allows trade.

Appeal process

If the application is refused or revoked the applicant may discuss the application with the appropriate council officers. Other than Judicial Review there is no statutory right of appeal against the council's decision.
