The planning system provides a framework for managing the development and use of land. A key element of this system is the preparation of plans, which establish where and what type of development might take place, and provides the basis for the consideration of planning applications.
The Planning and Compulsory Purchase Act 2004, which came into operation on the 28 September 2004, (“the Commencement Date”) has introduced new rules governing the way development plans are drawn up. Under this new system local planning authorities are now required to prepare a Local Development Framework (LDF).
The LDF will replace the existing South Derbyshire Local Plan adopted in 1998 with a portfolio of documents comprising:
The Local Development Scheme : this sets out the council’s programme for preparing the Core Strategy Development Plan Document, the Development Control Policies Development Plan Document, the Woodville - Swadlincote Town Centre Area Action Plan, and the Statement of Community Involvement. The council’s current LDS came into effect in March 2007
The Core Strategy: which will set the long-term vision, objectives and strategy for the spatial development of South Derbyshire and provide a framework for promoting and controlling development. The Core Strategy will provide the strategic direction to (and inform) all local development documents set out within the Local Development Framework.
The Woodville - Swadlincote Town Centre Area Action Plan : this document will provide the planning framework for a specific area where significant change is now needed. It will focus on how change, within a defined boundary of the Woodville, Swadlincote and Church Gresley, will be managed to deliver planned growth, stimulate regeneration and focus the delivery of area based regeneration initiatives (including a new Regeneration Route).
Generic Development Control Policies: this will set out a suite of polices which are required to ensure that all development within the district meets the spatial vision and objectives set out in the Core Strategy.
The Statement of Community Involvement (SCI): this sets out how the council intends to engage and consult local communities and others in the preparation of its planning documents. It also sets out how the council will consult on planning applications and other development control matters within the district. The SCI for South Derbyshire was adopted in March 2006.
The Annual Monitoring Report (AMR):an annual report submitted by the district council to the Secretary of State on the implementation of the Local Development Scheme and the extent to which policies set out in the LDF are being achieved.
Taken together the documents that will comprise the Local Development Framework will seek to manage future development within South Derbyshire in a manner that is both integrated and sustainable.
